1.Announcements day of sale takes precedence over all previous advertising and statements
2.Any desired inspections must be completed prior to sale day.
3.If survey is needed, property sells subject to final acreage and road frontage.
4.Property sells as is, where is meaning that you will be purchasing the property in its current condition without any guarantees or warranties from the seller regarding its condition. The seller makes no promises about the properties condition, either expressed or implied. The buyer is responsible for inspecting the property and determining its suitability for their intended use before bidding. Please note, property selling through auction as is where is does not necessarily mean that property has any defects but rather is representing the auction method of marketing and that inspections had to be completed ahead of time.
5.Title company handling the sale will be chosen by auction company and seller unless buyer has specific loan requirements that dictate otherwise.
6.Closing costs will be as follows: seller will pay cost of title search, deed preparation, county transfer fees, real estate taxes and assessments prorated to day of closing. Buyer will pay for survey if needed, broker fees, standard closing fees, commitment fees, title insurance, loan policies, title endorsements, and any other closing costs not mentioned above.
7.Buyer shall deposit with broker on day of sale, in immediately available funds. A deposit in the amount of 10% of the hammer price with a maximum of $5,000 down. This deposit is non-refundable. By bidding today you acknowledge that you have financing or cash to pay for the sale. Property is not contingent on any financing.
8.Buyers premium of 10% of the highest valid bid amount. The buyers premium will be added to the highest bid amount to determine the final purchase price of the property.
TERMS ON REAL ESTATE:
-Successful buyer will be required to deposit a $5,000 non-refundable down payment the day of auction, with balance due at closing (within 45 days). 10% buyer’s premium added to hammer price to make final purchase price.
-Property sells “as-is, where is” with no warranties implied or expressed.
-Property will sell with no contingencies, financing or other. If you will be financing, please bring loan approval letter.

When bidding on any lot offered by Tyler Faulk Auctioneer, LLC, the bidder indicates acceptance of the following Terms of the Sale. Any participation in the auction binds you to an agreement of these Terms and constitute a legal, valid, binding, and enforceable contract between Auctioneer and the Bidder. These Terms also form the basis for the final contract of sale between the Seller and the Buyer.These Terms apply to on site, online, phone bid, absentee or through any other form of bidding. Bidder agrees to be bound by, and to abide by, these Terms and Conditions.
Condition:
Item condition and description: The property is sold in "as is, where is" condition and without recourse, and neither the Auction house nor the consignor makes any representation of warranties, express or implied, as to catalogue description, attribution, authenticity, provenance, origin, size, age or condition of any of the property offered for sale. It is the responsibility of the purchaser, prior to the auction, to examine the property and make determination as to the value, condition, description, authenticity, provenance, origin, size, and age of the property. We do not accept returns. We would be glad to take additional photos or to answer any questions about the items we offer for auction.

Tyler Faulk Auctioneer does not accept PayPal or Venmo. We accept Visa, Mastercard, and Discover credit cards (4% fee if paying by card). Cash or good check. $2,500 or more-wire transfer required.
1. This is a live and webcast auction. If you plan to bid online, you must be registered on one of our online platforms. ONLINE: You MUST register for a bidder number to bid online, including those who have permanent bidder numbers for our on-site auctions. Click on the "Register to Bid" tab and follow the directions. A valid credit card is required to obtain a bidder number. A $1.00 charge will be placed on your card for validation purposes only. This charge will be credited back to you. You will receive an email once your registration has been approved and you will then be able to place bids. 2.Any form of bid submissions are a legal binding contract, in which you agree to pay the amount you bid if you are the winning bidder. Under no circumstances will bids be edited/cancelled. DO NOT bid if you DO NOT intend to purchase.
3. Upon completion of the sale, you will receive an electronic invoice identifying lot(s) purchased and balance due.
4. All items must be picked up immediately following sale unless prior arrangements have been arranged. Any items remaining will become property of auction house If the scheduled pick up times DO NOT work for you, please contact us PRIOR to placing bids to ensure we can accommodate you. Items still remaining on the property on JANUARY 4TH AT 4PM will become property of the auction company.

7. Auction company, auctioneers, and staff are not responsible for no shows. While we hope all items sent to us prior to the auction will show, sometimes this is not the case.
8. Persons attending during exhibition, sale or removal of goods assume all risks of damage of or loss to person and property and specifically release the auctioneer and seller from liability therefore. Neither the auctioneer nor his principal shall be liable by reason of any defect in or condition of the premises on which the sale is held.
9.The auctioneer reserves the right to withdraw from sale any of the property listed or to sell at this sale property not listed, and also reserves the right to group one or more lots into one or more selling lots or to subdivide into two or more selling lots. Whenever the best interest of the seller will be served, the auctioneer reserves the right to sell all the property listed, in bulk.
10.Dispute between bidders: The auctioneer`s decision will be final and absolute. The record of sale kept by the auctioneer and bookkeeper will be taken as final in the event of any dispute.
11. The auctioneer is acting as an independent contractor only and is not responsible for the acts of its principals or sellers.
12.The auctioneer may add other terms and conditions of sale, such additional terms and conditions to be announced prior to the auction.
13.The auctioneer reserves the right to reject any and all bids. On lots upon which there is a reserve, the auctioneer or his assigned agents, shall have the right to bid on behalf of the seller.
