Terms and Conditions for Tyler Faulk Auctioneer, LLC
All items are sold as is-where is with no warranties implied by the auction or its staff. Winning bidders will be notified of pick up location and time. Not responsible for any accidents.
Terms: 15% buyer’s premium on all ONLINE purchases. NO IN PERSON BUYERS PREMIUM

–Payment–
Tyler Faulk Auctioneer accepts Visa, Mastercard, Discover, Cash, Wire Transfer, and good check. Items over $2,500 require a wire transfer. If you place a winning bid in our online auctions, your card will be charged shortly after the conclusion of the auction or you will be notified to remit payment. If paying by card, an additional 4% processing fee will be added to total.
–Shipping–
SHIPPING is available for this auction. All items will be shipped through a third party called Shipping Saint. It is the BIDDER’S RESPONSIBILITY TO TAKE SHIPPING COSTS INTO CONSIDERATION WHEN BIDDING ON THESE ITEMS. Shipping methods include FedEx, UPS, USPS, or whatever method is best. Tyler Faulk Auctioneer cannot be responsible for loss or damage to the items during shipping. Items are insured through Shipping Saint. While we hope to get items shipped out as quickly as possible, timeframes can take up to 14 days depending on quantity of items needing shipped, auctioneers other auctions, size of items, and more. By buying an item via the online platforms, you are agreeing that you are aware of shipping terms stated in the terms and conditions. Items will most likely be shipped out within three business days but this is not a guarantee. Take into consideration size and weight when bidding on items.
–Trucking–
Trucking can be arranged for machinery and equipment hauling at the buyers expense.
–Conditions of Sale–
When bidding on any lot offered by Tyler Faulk Auctioneer, LLC, the bidder indicates acceptance of the following Terms of the Sale. Any participation in the auction binds you to an agreement of these Terms.
ALL SALES ARE FINAL .
Bidding—By bidding on an item, you are entering into a binding legal contract.
Condition—Item condition and description: The property is sold in “as is, where is” condition and without recourse, and neither the Auction house nor the consignor makes any representation of warranties, express or implied, as to catalogue description, attribution, authenticity, provenance, origin, size, age or condition of any of the property offered for sale. It is the responsibility of the purchaser, prior to the auction, to examine the property and make determination as to the value, condition, description, authenticity, provenance, origin, size, and age of the property. We do not accept returns. We would be glad to take additional photos or to answer any questions about the items we offer for auction.
1. Online bid submissions are a legally binding contract, in which you agree to pay the amount you bid if you are the winning bidder. Under no circumstances will bids be edited/cancelled. DO NOT bid if you DO NOT intend to purchase.
2. Upon completion of the sale, you will receive an electronic invoice identifying lot(s) purchased and balance due.
3. The credit card you enter at the time of registration WILL BE AUTOMATICALLY CHARGED AT THE COMPLETION OF THE SALE if payment is not made. We reserve the right to charge all non-paying bidders and they will be reported to various online platforms. CC fee is 4%.
4. If bidding online, there is a 15% buyer’s premium.
5. If you are unable to attend scheduled pickup time, please send someone else. If the scheduled pick up times DO NOT work for you, please contact us PRIOR to placing bids to ensure we can accommodate you. Any items that are paid for and not picked up will be shipped upon payment of shipping from buyer. Items become property of Tyler Faulk Auctioneer and considered abandoned if shipping is not paid for within 7 days. Items become property of Tyler Faulk Auctioneer and considered abandoned if no payment is made within 7 days for the items.
6. All items sold as-is, where-is, with no guarantees or warranties beyond what is implied. No refunds or returns.
7. Large items such as furniture, large signs, etc. may be FOR PICK UP ONLY or private courier delivery as selected by the winning bidder or recommended local agent from Tyler Faulk Auctioneer.
The buyer is free to contact any shipping company they wish, as the shipment is not limited to the agent provided by Tyler Faulk Auctioneer.
GUNS:
(Online Terms)
Basic Terms: All bidders must be at least 18yrs of age for long guns & 21yrs of age for handguns, and must reside in the United States. (No International shipping available.) (Residents of California or New York City, New York, DO NOT BID ON ANY FIREARMS) If you become the winning bidder of any lot, we will be contacting you for your FFL info (or Gun Shop info) for shipping purposes. All firearms need be shipped to an FFL holder (Gun Shop) in your state, unless pickup arrangements are made. Arrangements can be made to pick up your items at Dave’s Guns (Cambridge, OH) during their normal business hours. Buyer must then complete background paper work there.
Payment Terms: There will be a 15% Buyer’s Premium added to all online sales, plus shipping costs. Shipping costs of ($50 per long gun includes hard case unless in box) or ($25 per hand gun) or ($25 per lot, Knives & misc.) will be added to your invoice. Shipping costs will be refunded if items are picked up. If any one item, of the amount of $1,500 or over, shipping costs will be reevaluated and may be extra shipping costs.
(Onsite/Inhouse) Terms
Basic & Payment Terms for (Ohio) Residents: Payments to be made in full day of sale, and Buyers are to pick up all Firearms from Premises on day of sale. All bidders must be at least 18yrs of age for long guns & 21yrs of age for hand guns. Bidders or potential bidders must sign in for a bidder number card at the Gun Auction Office with valid identification (photo not required).
Basic & Payment Terms for (Non-Ohio) Residents: An additional Transfer Fee of $20 per gun will be added to all purchases, plus $25 shipping costs on all hand guns. (For hand guns over the amount $1,500 ea. Extra shipping costs may apply) Payments are to be made in full day of sale with the Gun Auction Office. Buyers must then complete Background paperwork with Dave’s Guns (Cambridge, OH), and pick up the Firearms (Long guns only) at Daves Guns within their regular store hours. All Hand guns need to be shipped to an FFL holder (Gun Shop) in your State. Bidders must be 18yrs of age for long guns or 21yrs of age for hand guns (If over 18 & under 21 there will be a 10-day background pending delay.) Bidders must sign in for a bidder number card at the Gun Auction Office with a valid (Photo ID) or Driver license. (Transfer fee’s & Background paperwork is exempt on Antique Muzzleloaders)
Additional Terms Info: No sales can be made to Residence to the state of California, or New York City
For Residents of Illinois & New Jersey, all Firearms (Long guns & Hand guns) need be shipped to FFL holder (Gun Shop) in their State.
